Terms of Service

1. Acceptance of Terms

By creating an account or using any SamMail service (including SamMail Mail, Calendar, Chat, Drive, Meet, Notes, Tasks, CRM, HR, and Invoicing), you agree to these Terms of Service ("Terms"), our Privacy Policy, and any additional terms applicable to specific services.

If you are using SamMail on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

If you do not agree to these Terms, you may not access or use SamMail's services.

2. Description of Services

SamMail provides a suite of personal and business productivity tools including:

• SamMail Mail — AI-powered personal and business email
• SamMail Calendar — Smart scheduling and calendar management
• SamMail Chat — Real-time messaging and collaboration
• SamMail Drive — Secure cloud file storage
• SamMail Meet — Video conferencing and meetings
• SamMail Notes — Personal and collaborative note-taking
• SamMail Tasks — Task and project management
• SamMail CRM — Customer relationship management
• SamMail HR — Human resources management
• SamMail Invoicing — Professional invoicing and billing

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice to users.

3. Account Registration

To use SamMail, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate
• Keep your password secure and not share it with any third party
• Be solely responsible for all activity that occurs under your account
• Notify us immediately at security@sammail.sa if you suspect unauthorized access

You must be at least 13 years old to create a SamMail account. By registering, you confirm that you meet this requirement.

Upon registration, you are required to complete your profile within 48 hours. If your profile is not completed within this period, your account will be automatically deleted. You may re-register at any time after deletion.

4. Acceptable Use Policy

You agree to use SamMail only for lawful purposes. You must not use our services to:

• Send spam, unsolicited bulk emails, or phishing messages
• Distribute malware, viruses, or any harmful software
• Harass, abuse, threaten, or impersonate any individual or entity
• Violate any applicable local, national, or international law or regulation
• Infringe on any intellectual property rights of SamMail or third parties
• Attempt to gain unauthorized access to any SamMail system or user account
• Use automated bots, scrapers, or crawlers without prior written permission
• Resell, redistribute, or sublicense SamMail services without authorization
• Engage in any activity that disrupts or interferes with our services

Violation of this policy may result in immediate suspension or termination of your account without notice.

5. Email-Specific Terms

SamMail is not intended for sending mass marketing emails from personal accounts. For business email marketing, dedicated plans are available.

6. Intellectual Property

SamMail's IP: All content, features, and functionality of the SamMail platform — including logos, software, design, and trademarks — are the exclusive property of SamMail and are protected by applicable intellectual property laws.

Your Content: You retain full ownership of any email content, files, or data you upload or create using SamMail. By using our services, you grant SamMail a limited, non-exclusive license to store and process your content solely for the purpose of providing the service to you.

You represent and warrant that you own or have the necessary rights to any content you submit, and that it does not violate the rights of any third party.

7. Privacy

Your use of SamMail is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Key privacy commitments include:

• We do not read your emails for advertising purposes
• Your data is encrypted at rest and in transit
• We do not sell your personal information to third parties
• AI features process your content within your session only

8. Service Plans & Payment

SamMail offers both free and paid subscription plans:

• Free plans are provided at no cost with limited storage and features
• Paid plans require a valid payment method and are billed as specified at signup
• Subscription fees are non-refundable unless required by applicable law
• We reserve the right to change pricing with 30 days notice to existing subscribers
• Failure to pay may result in service downgrade or account suspension

9. Termination

By You: You may terminate your account at any time by going to account settings and selecting "Delete Account." Upon termination, your data will be permanently deleted within 30 days.

By SamMail: We reserve the right to suspend or terminate your account if you:

• Violate these Terms or our Acceptable Use Policy
• Use the service in a way that creates legal liability for SamMail
• Fail to pay applicable subscription fees
• Are found to be engaged in fraudulent or illegal activity

We will provide notice where reasonably possible, except in cases of serious violations or legal requirements.

10. Disclaimers

SamMail is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Guarantees of uninterrupted or error-free service
• Guarantees regarding accuracy or completeness of AI-generated content

While we work hard to maintain high uptime and reliability, we cannot guarantee that the service will always be available or that emails will be delivered without delay.

11. Limitation of Liability

To the maximum extent permitted by applicable law, SamMail shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of (or inability to use) the service.

Our total liability to you for any claims arising from these Terms or your use of the service shall not exceed the amount you paid to SamMail in the 12 months preceding the claim, or SAR 500, whichever is greater.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, without regard to its conflict of law principles.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Kingdom of Saudi Arabia, unless otherwise required by applicable consumer protection laws in your jurisdiction.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through your SamMail account or by email at least 14 days before the changes take effect.

Continued use of SamMail after the effective date of any changes constitutes your acceptance of the revised Terms.
